Japan's METI Warns Companies to Comply with the Chemical Substances Control Law The Ministry of Economy, Trade and Industry (METI) recently issued a notice requiring companies to strictly comply with the Chemical Substances Control Law (CSCL). The notice also lists the most common corporate violations, exemplified as follows: \u2013 Mistaking new chemical substances for general chemical substances. The former requires a preliminary assessment before production\/import; the latter only requires notification of the production or import volume to the government. \u2013 Manufacturing or importing small quantities of chemical substances exceeding the permitted weight. For small quantities of chemical substances and intermediates, companies must specifically declare the expected production\/import volume and obtain permission before proceeding (to ensure that the annual production\/import volume of small quantities of chemical substances does not exceed one ton, inter-ministerial coordination of permit\/declaration quotas is necessary). \u2013 Failure to submit hazardous chemical test reports required by government departments. METI points out that most corporate violations stem from a lack of understanding of the CSCL or poor implementation of internal chemical substance management systems. To prevent similar violations from recurring, METI recommends that companies implement the following: \u2013 Provide internal training on the Chemical Hazards Assessment Act for management and production line personnel exposed to hazardous substances; \u2013 Establish an internal hazardous substance management system and ensure that employees comply with the requirements of the Chemical Hazards Assessment Act; \u2013 Assess whether a chemical substance is new before producing or importing it. Check the composition and structure of the chemical substance on the Chemical Risk Information Platform website provided by the National Institute of Technology and Evaluation (NITE) to confirm whether the chemical substance is new and requires relevant reporting; \u2013 Strictly adhere to the permitted production\/import quantities when producing\/importing intermediates, or small or low-quantity chemical substances; \u2013 Ensure that all hazardous substance-related information is reported to the relevant government authorities as required by regulations. According to the Chemical Hazards Assessment Act, companies must provide hazardous substance-related information during priority assessments for specific Class II specified chemicals, general chemicals, and new chemicals (excluding intermediates). METI concludes that companies must designate a specific department within their organization to collect and organize hazard information on chemical substances and maintain continuous contact with testing agencies to comply with the requirements of the Chemical Hazard Information Platform.
