On November 24, 2010, the European Parliament voted to approve the European Commission's draft amendments to the Restriction of Hazardous Substances Directive (Directive 2002\/95\/EC). This directive restricts hazardous substances used in electrical and electronic equipment. The revised legislation restricting hazardous substances was scheduled for adoption by the Council of the European Union on December 20. The new legislation was published in the Official Journal of the European Union in early 2011 and came into effect 20 days later. Member States had 18 months to transpose the new directive into national law.<\/p>\n\n\n\n

The key points of the new regulations restricting hazardous substances are as follows:<\/p>\n\n\n\n

category<\/td>It will continue to apply to electrical and electronic equipment covered by the existing Restriction of Hazardous Substances Directive, but will also cover medical devices, surveillance equipment, and other electrical and electronic equipment not specifically excluded, such as toys with electronic functions or extended wires.<\/td><\/tr>
Transition period of categories<\/td>The scope of coverage will be expanded, but the transition period will be as long as 8 years. Products that were not covered by the current directive but became non-compliant under the new regulations can continue to be launched on the market within 8 years after the new regulations take effect.<\/td><\/tr>
Products explicitly excluded<\/td>Military equipment necessary for security, equipment intended for use in outer space, large industrial tools and fixed installations with fixed locations, passenger and freight transport vehicles, off-road specialized mobile machinery, photovoltaic panels, etc.<\/td><\/tr>
definition<\/td>Include clear definitions, such as the specific meaning of a cable.<\/td><\/tr>
Restricted substances<\/td>The new regulations still only apply to the six substances restricted by the current directive (see Annex II of the directive). The new regulations stipulate that the European Commission must review the directive three years after it comes into effect to consider whether the list of restricted substances needs to be revised.<\/td><\/tr><\/tbody><\/table><\/figure>\n<\/div>\n<\/div>\n\n\n\n

The review items include whether these substances will have adverse effects during waste management, whether they will seep into the environment uncontrollably, and whether workers will be excessively exposed to them during waste disposal.<\/p>\n\n\n\n

Proposal to amend the list of restricted substances: If the European Commission, after review, deems it necessary to add more substances to Annex II, the regulation can be amended through a fast-track procedure. The European Commission is currently developing a common definition for nanomaterials, believing that the directive covers different forms of restricted substances, including nanomaterials.<\/p>\n\n\n\n

Exemptions: The new directive lists various exemptions for different uses, which the European Commission will continue to revise in the future. Exemptions are typically granted for 5 or 7 years, but extensions are possible. Applications to propose, extend, or cancel an exemption must be submitted to the European Commission.<\/p>\n\n\n\n

Responsibilities of Manufacturers, Importers, and Distributors: The new directive adds new responsibilities to businesses. Manufacturers must prepare technical documentation and establish internal production control procedures, and affix batch numbers and manufacturer information to their products. Importers' primary responsibility is to ensure that manufacturers have conducted appropriate conformity assessment procedures and prepared technical documentation; and to ensure that electrical and electronic equipment bears the CE marking and required documentation. Distributors must ensure that electrical and electronic equipment is accompanied by the required documentation, and that the language of the documentation is easily understood by consumers in Member States.<\/p>\n\n\n\n

Regarding the Waste Electrical and Electronic Equipment Directive (WEEE), its first reading in the European Parliament was hampered by controversy and delays, slowing down the legislative process. Reasons included the failure to reach a consensus on the recycling target (the European Parliament hopes to achieve 85% by 2016) and scope (whether it should cover all electrical and electronic equipment). The Parliament's latest report indicates that the WEEE amendment will be discussed at the plenary session in early February 2011. A final decision is expected to be made and adopted in the first half of 2011. Member states will have 18 months to transpose the new WEEE Directive into national law.<\/p>\n\n\n\n
