Resolution 2009\/251\/EC prohibited the placement of all products containing dimethyl fumarate (DMF) on the EU market.<\/p>\n\n\n\n<p>In France, Poland, Finland, Sweden, and the United Kingdom, consumers reported severe allergic reactions. Investigations revealed that dimethyl fumarate was the cause. Subsequently, in March 2009, the European Union adopted Resolution 2009\/251\/EC, which required member states to ensure that products containing dimethyl fumarate were not placed on the market and to recall products containing dimethyl fumarate from the market from May 1, 2009.<\/p>\n\n\n\n<p>Dimethyl fumarate is a biocidal agent used in the manufacture of packaging for footwear, furniture, and electronic products to prevent leather parts or objects from becoming moldy and spoiling due to moisture during storage and transportation. Dimethyl fumarate is often packaged in small containers inside furniture and shoe boxes. After evaporating, it adheres to the product and, upon contact with the consumer's skin, can cause dermatitis, itching, irritation, redness, and burns, and may even cause breathing difficulties.<\/p>\n\n\n\n<p>Although foreign manufacturers could still use dimethyl fumarate in products exported to the EU until the EU adopted resolution 2009\/251\/EC in 2009, EU Directive 98\/8\/EC has banned the use of dimethyl fumarate in products manufactured in the EU.<\/p>\n\n\n\n<p>In 2009, the European Union first implemented a ban on dimethyl fumarate under Article 13 of Directive 2001\/95\/EC (General Product Safety Directive). Article 13 stipulates that the ban is valid for one year, but may be extended, but not for more than one year at a time.<\/p>\n\n\n\n<p>Since no definitive solution could be reached, the European Commission adopted resolution 2012\/48\/EU on January 26, 2012, extending the ban again until March 15, 2012. However, this ban is expected to continue to be extended until the EU adopts a permanent regulatory solution.<\/p>\n\n\n\n<p>In September 2011, the European Commission, after consulting with the socio-economic analysis committee of the European Chemicals Agency (ECHA), issued a draft regulation banning the use of dimethyl fumarate in consumer products on the EU market. According to the proposal, dimethyl fumarate would be included in Annex 17 of the EU's Registration, Evaluation and Authorization of Chemicals Regulation, permanently restricting its use in all EU countries. Implementing restrictions across the EU is considered the most appropriate way to reduce consumer risk. A committee composed of representatives from member states is currently reviewing this proposal.<\/p>\n\n\n\n<p>European Commission resolution 2009\/251\/EC applies to all products intended for or likely to be used by consumers. A product is considered to contain dimethyl fumarate if the content of dimethyl fumarate in the product or part thereof exceeds 0.1 mg\/kg by weight.<\/p>\n\n\n\n<p>Member States must comply with Resolution 2012\/48\/EU by 15 March 2012, extending the ban for another year.
