The European Commission is seeking an exemption for used electrical and electronic equipment (EEE) from the RoHS ban. The Commission has proposed that items containing hazardous substances should be excluded from the RoHS Directive's 2019 expiry date. The RoHS Directive restricts the content of hazardous substances in electrical and electronic products and explicitly prohibits the sale of all non-compliant EEE products, whether first-time marketed or used, after July 22, 2019. Products most significantly impacted by these secondhand market restrictions are medical devices, surveillance equipment, and other EEE products recently incorporated into the RoHS framework. The Commission argues that this barrier to the secondhand market is inconsistent with the overall harmonization of EU product regulations and therefore proposes excluding compliance requirements for used EEE products and components. The RoHS Directive already provides exemptions for general RoHS restricted substances for wires and components used for repair, reuse, functional upgrades, or performance enhancements. However, for non-medical devices or monitoring equipment, other electronic and electrical products newly included in the RoHS directive, no second-hand spare parts will be available for repair after July 22, 2019. The fundamental reason for the European Commission's recommendation is the EU's active promotion of the circular economy this year. One principle of the circular economy is extending the lifespan of products, and achieving this requires the availability of spare parts that can be repaired or upgraded. Therefore, to implement the circular economy strategy, the EU recently began reviewing regulations and directives, hoping to promote the development of technologies, products, and services that facilitate the circular economy through legislative amendments.
