The European Chemicals Agency (ECHA) launched a public consultation on January 14, 2009, for the draft first edition of the Recommended List of Authorized Substances (Annex XIV). Interested parties were able to submit their suggestions on the following topics via the ECHA website form by April 14, 2009:<\/p>\n\n\n\n

The European Chemicals Agency recommends selecting substances from the candidate list of Substances of Very High Concern (SVHCs). The seven substances prioritized for inclusion are:<\/p>\n\n\n\n

In the first draft of the recommended list of authorized substances, the European Chemicals Agency further recommended the following:<\/p>\n\n\n\n

\"\"<\/td>To obtain authorization to use the substance, an application should be submitted within 24 to 30 months of its inclusion in Annex XIV of REACH.<\/td><\/tr>
\"\"<\/td>Substances included in the list cannot be used 42 to 48 months after being added to the list.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n

Penalties<\/strong>
The REACH Directive requires member states to establish their own penalties; the following are countries that have already done so.<\/p>\n\n\n\n

U.K.<\/td>Fine and 2 years imprisonment<\/td><\/tr>
France<\/td>Fines and\/or bans on product imports (regulations not yet announced).<\/td><\/tr>
Germany<\/td>Fine and 5-year prison sentence<\/td><\/tr>
Netherlands<\/td>A fine of 670,000 euros was suspended, resulting in a six-year prison sentence.<\/td><\/tr>
Spain<\/td>Draft penalty rules passed<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n

ECHA may revise the draft recommendation based on suggestions gathered during the consultation period, taking into account the opinions of the Member States Committee. The final draft recommendation will then be submitted to the European Commission for a final decision.<\/p>\n\n\n\n
