The 2017 EU REACH Authorization List added 12 substances based on the European Commission's recommendations for amendments to Annex 14 of ECHA Fifth and Sixth Editions. Annex 14 now lists a total of 43 authorized substances. After the sunset deadline, substances on the list can only be used within the EU after obtaining authorization. The Forum for Exchange of Information on Enforcement (FOI) audited 13 authorized substances whose 2015 expiry dates for sale, verifying whether the substances were used or circulated on the market without authorization or did not comply with the relevant requirements of the authorization. This audit program covered 17 countries, with a total of 802 audits. Nearly 80% of the businesses audited were small and medium-sized enterprises (SMEs), and more than 90% of the businesses no longer used or sold the 13 authorized substances. For businesses that were authorized to use or provide substances for circulation on the market, the audit results showed a violation rate of 10.7% and 8.9%, respectively. Auditors issued verbal and written recommendations, or imposed administrative orders or filed lawsuits against businesses that violated regulations. In addition to proposing the addition of an authorized substance audit program, the working group of this audit program recommended that businesses implement operational control and risk management measures in accordance with the substance authorization order regulations for substances with expiring dates.
