On March 31, 2011, the Official Journal of the European Union published European Commission Directive 2011\/37\/EU. According to this directive, certain categories of automotive parts may still contain heavy metals such as lead and cadmium. While Directive 2000\/53\/EC concerning end-of-life vehicles prohibits the use of lead, mercury, cadmium, or hexavalent chromium in materials and parts of vehicles placed on the market after July 1, 2003, it allows for certain exemptions, details of which are listed in Annex II of the directive. Some exemptions have expiration dates. Vehicles placed on the market before the expiration date may contain heavy metals prohibited in materials or parts. Annex II specifies that replacement parts placed on the market after July 1, 2003, are exempt from this restriction if they are used in vehicles already placed on the market before that date. This exemption allows vehicles already placed on the market before the ban came into effect to be repaired using parts that comply with the safety and quality requirements for original equipment parts. However, spare parts for newer vehicles (i.e., vehicles put on the market after July 1, 2003, but before the exemption expires) are not exempt. In other words, these spare parts must be free of heavy metals, even if they are used to replace parts that originally contained prohibited heavy metals. The new Commission directive acknowledges that in some cases, it is technically impossible to repair a vehicle with non-original spare parts. Some vehicle systems are manufactured with parts containing heavy metals, and these spare parts simply cannot be installed in these systems. In other words, such vehicles are practically unrepairable and often must be scrapped prematurely. Therefore, the new regulations aim to amend Annex II of the End-of-Life Vehicles Directive to allow for the repair of such vehicles. The new regulations stipulate that, effective December 31, 2011, Member States must replace Annex II of Directive 2000\/53\/EC with the new Annex II of Commission Directive 2011\/37\/EU. The amendments to Annex II by Commission Directive 2011\/37\/EU include: \u2022 Use of lead as an alloying element: continuously galvanized steel sheets with a lead content of up to 0.35% by weight, with exemptions applicable to vehicle categories and parts thereof approved before January 1, 2016; \u2022 Use of lead and lead compounds in parts:<\/p>\n\n\n\n
Regarding shock absorbers, the exemption applies to vehicle categories and parts for those vehicles approved before January 1, 2016; For capacitors with a rated voltage of less than 125 volts AC or 250 volts DC, the exemption applies to vehicle categories and parts for those vehicles approved before January 1, 2016. The new annex must be implemented in the 27 EU member states from the end of this year.
