EU RoHS Directive Exemption Expiration Reminder & Related Updates

Several lighting-related exemptions in EU RoHS Annex III have gradually expired since 2023. Companies should pay special attention to the impact of the implementation of a new wave of expiring items starting in 2025.

EU RoHS exemption clause expiration

As of February 24, 2025, the EU RoHS Directive’s exemptions for mercury in the following lamps listed in Annex III will expire:

  1. Mercury in single-capped (compact) fluorescent lamps shall not exceed:
    • 1(f)-II. Special use: 5 mg/lamp
  2. The mercury content in other types of fluorescent lamps shall not exceed:
    • 2(b)(3). Non-straight tri-color fluorescent lamps (e.g. T9) with a tube diameter >17 mm: 10 mg/lamp;
    • 2(b)(4)-I. Lamps used for other general lighting purposes or special lighting purposes (e.g., induction lamps): 15 mg/lamp.
  3. Mercury in cold cathode fluorescent lamps and external electrode fluorescent lamps (CCFL and EEFL) for special purposes shall not exceed:
    • 3(a). Shorter length (≤ 500 mm): 3.5 mg/lamp;
    • 3(b). Medium length (500 mm < length ≤ 1500 mm): 5 mg/lamp;
    • 3(c). Longer lengths (> 1500 mm): 13 mg/lamp.
  4. 4(f)-I. Mercury in discharge lamps for other special purposes not specifically mentioned in Annex III.

Progress on Revision of RoHS Exemptions

On January 6, 2025, the European Union submitted three notifications to the World Trade Organization (WTO) concerning proposed amendments to several common use exemptions in Annex III of the RoHS Directive. These amendments cover Articles 6(a), 6(a)-I, 6(b), 6(b)-I, 6(b)-II, 6(c), 7(a), 7(c)-I, and 7(c)-II. These amendments primarily address the use of lead in materials such as steel alloys, aluminum alloys, copper alloys, high-melting-point solders, and glass and ceramics used in electrical and electronic components.

At present, the amendment is still awaiting final review and approval by the EU officials. If approved, it will be officially announced in the Official Gazette.

Reminder for the industry to pay attention to EU RoHS related updates

Exemption clauses are one of the core contents of the EU RoHS Directive and are included in Annex III and Annex IV respectively. Among them, Annex III is an exemption for all electronic and electrical equipment applications, while Annex IV is an exemption specifically for medical and monitoring equipment applications.
