The EU has announced a new RoHS Directive (Directive 2011/65/EU) that allows a range of off-the-books items, such as electronic and electrical appliances containing lead or mercury, to be placed on the EU market, only if viable alternatives have not yet been developed for their use in specific applications.

Annex III adds two exclusions as follows:
