Recent Developments in Nordic RoHS Enforcement Investigations NO.24/2008

Earlier this year, the RoHS enforcement agencies of the three Nordic countries (Denmark, Sweden, and Finland) released the results of an investigation into 152 electronic products sold by importers, manufacturers, and retailers. Of these, 22 products failed to meet RoHS requirements, and one product resulted in a lawsuit. Christina Larsson, head of enforcement at the Swedish Chemicals Agency (KEMI), stated that most of the products that failed to comply with RoHS requirements had lead levels in their plastics or solders exceeding legal limits.

The case involves unbranded electronic glue guns imported from China by a Swedish importer. The power cord plug contained more than 1% lead. Under Swedish RoHS law, manufacturers of non-compliant products face a maximum penalty of two years imprisonment. EE Times also reported that the UK's RoHS enforcement agency, the National Weights and Measures Laboratory (NWML), not only issued formal warnings for two RoHS-non-compliant products but also blocked another non-compliant product from entering Europe (arriving shipment). KEMI focused its RoHS investigation on products with short sales lifecycles, such as small household appliances like MP3 players. KEMI's investigation found that most companies lacked the ability to submit documentation demonstrating RoHS compliance, a situation also observed at the UK's NWML. KEMI expects to publish its final RoHS enforcement report this autumn, and the agency plans to conduct more product investigations throughout 2008.
