EU announces suspension of new proposals for MCCPs and TBBP-A

On December 10, 2024, the EU suspended its proposal to add medium-chain chlorinated paraffins (MCCPs) and tetrabromobisphenol A (TBBP-A) to the RoHS Directive. Previously, these two substances had been proposed for inclusion in the RoHS restricted substances list after public consultation and evaluation. Following discussions with stakeholders and information collection, the adoption date for this proposal was postponed from the fourth quarter of 2022 to the fourth quarter of 2023. Following further evaluation, the EU ultimately decided to suspend the proposal, but stated that the feedback received from stakeholders remains available for future consideration. Therefore, companies must continue to monitor future updates and changes to the EU RoHS Directive to ensure product compliance.

SGS Experts Remind: MCCPs and TBBP-A Regulations Still Require Attention

Although medium-chain chlorinated paraffins (MCCPs) and tetrabromobisphenol A (TBBP-A) are not currently regulated by the EU RoHS Directive, they are subject to close scrutiny by local governments due to their potential to cause unacceptable health and environmental impacts during the disposal and recycling of electronic and electrical products. Furthermore, both MCCPs and TBBP-A are included on the SVHC (Substances of Very High Concern) candidate list under the EU REACH regulation. Under this regulation, companies are required to notify and report these substances when their concentration in an article exceeds 0.1%. In addition, common international regulations such as US CP65, REACH Annex XVII, and the Stockholm Convention also impose restrictions or propose new controls on these substances.

SGS recommends that companies closely monitor updates to international regulations on banned and restricted substances and promptly adjust product and supply chain control strategies to ensure that their products comply with local market requirements. Current Application and Control Status of Medium-Chain Chlorinated Paraffins (MCCPs) and Tetrabromobisphenol A (TBBP-A)

Medium-chain paraffin chlorides (MCCPs) (including straight or branched paraffin chlorides with carbon chain lengths of C14-C17)
Common UsesPVC, soft plastic materials, rubber materials, coatings, flame retardants, sealants, especially widely used in wire and cable manufacturing.
Current regulatory statusREACH SVHC (Effective): MCCPs were added to the SVHC Candidate List starting July 2021. REACH Annex XVII (Awaiting Announcement): In July 2022, ECHA proposed adding MCCPs to the REACH restricted substances list, and an official announcement is currently awaited. Stockholm Convention (Proposal in Progress): In October 2023, POPRC-19 recommended adding MCCPs to Annex A, implementing a complete ban.
四溴雙酚A(TBBP-A)
Common UsesMainly used as a reactive flame retardant in electronic and electrical products.
Current regulatory statusREACH SVHC (in effect): TBBP-A has been included in the SVHC candidate list since January 2023. TSCA (in effect): US regulations require companies to confirm whether the substance is an active substance and fulfill SNUR (Significant New Use Report) and CDR (Chemical Data Report) obligations based on its use. CP65 (in effect): To prevent contamination of drinking water sources, manufacturers and distributors are required to provide clear and reasonable warning labels.
