The Secretariat of the European Parliament published a document responding to the draft amendment to the RoHS Directive on September 3, 2009. The content of the document mainly provides suggestions and responses to the draft version of the proposed amendments to the RoHS Directive announced by the European Commission on December 3, 2008. Its key points include:
l All electrical and electronic equipment (Electrical and electronic equipment) are included in the scope of the RoHS Directive. The current exclusions include large-scale stationary industrial tools (largescale stationary industrial tools) and musical pipe organs;
l Delete Appendix 1 (categories of electronic and electrical equipment) and Appendix 2 (products covered in each category) in the first version of the RoHS amendment draft;
l Change the existing strategy of expanding control of restricted substances. Appendix 3 in the first version of the draft amendment was deleted, and the four newly added restricted substances that were originally expected to be added were changed to substances that were prioritized for inclusion in the assessment. It is also recommended that the Executive Committee should adopt a method similar to that of REACH regulations to control chemical substances. Appendix 4 in the first version of the draft amendment has been retained and lists six chemical substances controlled by the current RoHS directive.
l As for the responsibilities and obligations of manufacturers, importers and distributors, including: before any electronic and electrical equipment is placed on the EU market, the importer must confirm that the manufacturer has complied with regulatory requirements; the importer must also note its company name , registered trade name or trademark, and contact address and other information.
l CE marking requirements. (The current RoHS directive does not have this requirement.)
l Another difference from the current RoHS Directive is that the application process for exclusion clauses has changed; if a company wants to extend the current exclusion period, it needs to re-apply every four years.
l Medical devices and monitoring instruments remain within the control scope of the RoHS Directive, and the exemptions for these two categories of products are described in detail in Appendix 4 of the proposed amendment draft.
