The U.S. Consumer Product Safety Commission has decided to postpone the implementation of testing and certification requirements for certain products for one year.

On January 30, 2009, the U.S. Consumer Product Safety Commission (CPSC) announced on its official website that it had decided to postpone for one year the implementation of the proposed testing and certification requirements for certain products manufactured and imported by manufacturers and importers, including products for children aged 12 and under, scheduled to begin on February 10, 2009. The Consumer Product Safety Improvement Act (CPSIA) adds product testing and certification requirements to all products that comply with CPSC regulations or prohibitions.

While this resolution eliminates the need for manufacturers and importers of children's products (large or small) to submit test or certification reports that comply with the new legislation, they still need to meet restrictions on lead and phthalates, mandatory toy standards, and other requirements.

The Committee decided to postpone the implementation of the rule for one year, until February 10, 2010, after a new vote by the Committee. This suspension decision does not apply to:

	Third-party testing and certification requirements for certain regulated children's products:
	A ban on lead paint and other surface coatings manufactured after December 21, 2008 Standards for full-size and non-full-size cribs and pacifiers manufactured after January 20, 2009 <img decoding="async" height="10" width="13" ) Products manufactured after February 15, 2009, are prohibited from using small parts. Lead content limits for metal parts in children's jewelry manufactured after March 23, 2009 Lead content limits for metal parts in children's jewelry manufactured after March 23, 2009
	Certification requirements for all-terrain vehicles (ATVs) manufactured after April 13, 2009
	Product testing and certification requirements that existed before the CPSIA Act were enacted include: door openers, bicycle helmets, metal candle wicks, lawnmowers, lighters, mattresses, and swimming pool waterslides.

The committee believes that state attorneys general will respect the committee's decision to postpone testing and certification and focus on the effectiveness of other provisions, such as the recall of defective products.
