Definition of Battery Producer
According to Article 3 of the Directive, a “producer” means a person who, for the first time, manufactures or supplies a battery/rechargeable battery (including those used in household appliances/vehicles) to a third party within the territory of a Member State. This definition is unrelated to sales techniques or whether there are recycling fees for the batteries.
Battery Manufacturers – Examples
Battery manufacturers or domestic importers purchase batteries from retailers and resell them to end-users within member countries.
Battery manufacturers or domestic importers are the first to supply batteries to the market, therefore they are the producers.
Retailers sell batteries purchased from other member countries (outside the member country) within the member country.
Retailers sell batteries purchased in other countries to users within the member country. Since this retailer is the first to supply batteries for sale in the member country's market, the retailer is the producer.
Equipment/vehicle manufacturers purchase batteries within a Member State and sell the equipment/vehicles together with the batteries within the same Member State
Battery manufacturers or domestic importers within a Member State sell batteries within that Member State, and equipment or vehicle manufacturers install the batteries in their equipment or vehicles and sell them in the Member State's domestic market. Battery manufacturers or domestic importers are considered producers because they are the first to supply batteries for sale on the market.

Equipment/vehicle manufacturers who purchase batteries outside a Member State and then sell the batteries along with the equipment/vehicle within a Member State
If an equipment/vehicle manufacturer installs batteries in equipment/vehicles and sells them within a Member State, and the batteries were purchased from outside the Member State, then the equipment/vehicle manufacturer is the first person to supply batteries to that Member State, and therefore they will be considered the battery producer for that Member State.

Batteries or battery packs sold in a Member Country to battery assemblers and sold within the same Member Country
