South Korea will implement K-REACH from January 2015

On May 22, South Korea's Ministry of Environment (MOE) passed the "Chemicals Registration and Assessment Act" (K-REACH). Effective January 1, 2015, all new chemical substances and priority chemical substances produced or imported in quantities exceeding 1 tonne per year must be registered with the MOE. Hazard assessment is mandatory for all registered chemical substances, while substances exceeding 100 tonnes per year require a risk assessment. K-REACH is a chemical management system based on the EU's REACH regulation. Its purpose is to protect human health and mitigate the environmental risks posed by the use of chemical substances, and it also includes risk assessment and safety labeling standards.

The main specifications are as follows:

Registration and Reporting of Chemical Substances

The production or import of new chemical substances and priority chemical substances (more than 1 ton/year) requires registration. Whether it is a chemical manufacturer, importer, or downstream user (use or sale), information on the quantity of new or existing chemical substances (more than 1 ton/year) must be reported annually.
Hazard/Risk Assessment
From January 1, 2015, a risk assessment is required for any chemical substance produced or imported in quantities exceeding 100 tons per year. A grace period of 2-5 years is granted for substances produced in the 10-100 tons per year period, with the specific implementation periods as follows:

● January 1, 2017 (70 tons/year)
● January 1, 2018 (50 tons/year)
● January 1, 2019 (20 tons/year)
● January 1, 2020 (10 tons/year)

Information Sharing in the Supply Chain

Chemical suppliers are required to communicate registration numbers, chemical names, hazard information, and safe usage information to downstream users, and this information must be reflected in the MSDS. When requested by downstream users, upstream suppliers are obligated to provide information on chemical use and exposure, quantities used or sold, and safe usage information.
Product Risk Management

Products containing hazardous substances with an intended release concentration exceeding 1 ton/year require declaration; the name, concentration, and hazard information of the hazardous substances must be reported in advance. The MOE will publish relevant safety and labeling standards for risk assessment. Products without safety and labeling standards must be approved by the MOE.
Compared to other international chemical management systems, the MOE enhances its competitiveness in chemical management through K-REACH. Companies should also maintain chemical information management systems, such as Material Safety Data Sheets (MSDS), to reduce risks and prevent accidents.
