The EU has released major revisions to the RoHS Directive exemption program.

No. 02/ 2010

On 8 February 2010, the European Commission published notification G/TBT/N/EEC/313 (draft decision of the European Commission), making significant revisions to the annex to the existing RoHS Directive (2002/95/EC) regarding exemptions for applications containing lead, mercury, cadmium, hexavalent chromium, polybrominated biphenyls and polybrominated diphenyl ethers.

Under the RoHS Directive, if it is technically or scientifically impractical to remove these hazardous substances from certain applications, the European Commission may grant exemptions for substances prohibited under Article 4(1) of the Directive. The European Commission is responsible for reviewing those exemptions at least every four years and removing them (from the Annex) if the use of alternative substances in those applications becomes feasible. This draft resolution mainly addresses the review of exemptions for mercury in lighting equipment such as fluorescent lamps, high-pressure sodium (vapour) lamps, and metal halide lamps, as well as exemptions for hazardous substances such as lead, cadmium, or hexavalent chromium. It also sets expiry dates for some future exemptions that may be technically or scientifically feasible. This draft resolution is open to suggestions from all parties for 60 days from the date of notification. The proposed entry into force (proposed approval date) is June 2010.

For the full details, please refer to the original notification document.
