California takes the lead in restricting phthalates in toys and child care products

In early 2007, San Francisco introduced Amendment 120-06, reiterating the ban on phthalates in toys, childcare products, and child-feeding products. On October 14, 2007, the Governor of California passed AB 1108. Starting January 1, 2009, this law restricted the manufacture and sale of certain toys and childcare products to limits exceeding the limits for six phthalate compounds. Phthalates are chemicals used to increase the plasticity of polyvinyl chloride (PVC) plastic products and to incorporate fragrances into cosmetics. They are used in many products children use, such as teethers, toys, and soft plastic books. In California, DEHP, DBP, BBP, and DIDP are known carcinogenic or toxic chemicals. A toy is defined as "any product designed or intended by a manufacturer to be used by a child for play." Child care articles are defined as "any product that helps a child sleep, relax, maintain hygiene, or feed or allow a child to suck, including pacifiers of all shapes and types".

The six phthalate restrictions imposed by California's AB 1108 are exactly the same as those stipulated in EU Directive 2005/84/EC, as shown in the table below:
