China's WEEE will officially implement NO.9/2009 in 2011

The State Council of the People's Republic of China adopted the "Regulations on the Management of Recycling and Disposal of Waste Electrical and Electronic Equipment" (hereinafter referred to as WEEE China) on August 20, 2008, and promulgated it on February 25, 2009, effective January 1, 2011. These regulations apply to the recycling and disposal of all waste electrical and electronic equipment listed in the "Catalogue of Waste Electrical and Electronic Equipment for Disposal." China will implement a multi-channel recycling, centralized processing, and qualification licensing system for waste electrical and electronic equipment.
China WEEE Basic Regulations

China's WEEE (Waste Electrical and Electronic Equipment) regulations require that electrical and electronic product manufacturers, importers, or their agents produce or import electrical and electronic products that comply with national regulations on pollution control for electrical and electronic products. These products must employ design schemes conducive to comprehensive resource utilization and harmless treatment, and use non-toxic/low-toxic and easily recyclable materials. Furthermore, information regarding the content of toxic and hazardous substances and recycling instructions must be provided on the electrical and electronic products or in their instruction manuals as required. **Except for centralized waste electrical and electronic equipment treatment plants with complete centralized pollutant treatment facilities, enterprises may only engage in waste electrical and electronic equipment treatment activities after obtaining government approval within 60 days of applying for registration. Units and individuals without waste electrical and electronic equipment treatment qualifications are prohibited from processing waste electrical and electronic equipment. Qualified treatment enterprises are prohibited from using technologies and processes that are explicitly prohibited from being used to treat waste electrical and electronic equipment.** A routine environmental monitoring system and data management system for the disposal of electrical and electronic products should be established. Basic data and relevant information on the disposal of waste electrical and electronic products should be reported to the environmental protection department of the municipal people's government where the product is located, and the retention period for such basic data shall not be less than 3 years.

Penalties

Manufacturers of electrical and electronic products, consignees of imported electrical and electronic products, or their agents who fail to provide information on the content of toxic and hazardous substances or instructions for recycling and disposal in accordance with regulations on the electrical and electronic products they produce or import, will be ordered to rectify the situation within a specified period and will be fined up to RMB 50,000.

Anyone who engages in the disposal of waste electrical and electronic products without obtaining the necessary qualifications will be ordered to cease operations and close down, have their illegal gains confiscated, and be fined between RMB 50,000 and RMB 500,000.
